The Careers Development Group website located at https://careersdevelopmentgroup.com is a copyrighted work belonging to AMS Consulting UG, Berlin, Germany. Certain features of the Site may be subject to additional guidelines, terms, or rules, which will be posted on the Site in connection with such features.

All such additional terms, guidelines, and rules are incorporated by reference into these Terms.

These Terms of Use described the legally binding terms and conditions that oversee your use of the Site. BY LOGGING INTO THE SITE, YOU ARE BEING COMPLIANT THAT THESE TERMS and you represent that you have the authority and capacity to enter into these Terms. YOU SHOULD BE AT LEAST 18 YEARS OF AGE TO ACCESS THE SITE. IF YOU DISAGREE WITH ALL OF THE PROVISION OF THESE TERMS, DO NOT LOG INTO AND/OR USE THE SITE.

WORKSHOP AND GENERAL SERVICE TERMS AND CONDITIONS OF CDG (Careers Development Group) represented by AMS CONSULTING UG

1. Drafting of contracts

1.1. The conclusion of contracts between workshop participants / clients and workshop organiser / consulting service provider (= CDG, Career Development Group represented by AMS Consulting UG) about the services to be provided by both parties, as well as changes and / or additions to this, must be in writing.

1.2. These terms and conditions have priority over conflicting terms and conditions of the client.

1.3. The workshop participant recognizes the organizer's rights during the event.

 

2. Services of the organizer

2.1. The appearing trainers are free to design their talk and are responsible for the content of the workshop talk. The organizer is entitled to make necessary or appropriate changes to the workshop programs. This applies in particular to the appointment of a substitute speaker in the event of a trainer's failure, as well as an associated change in the workshop date and location. If an appointment for the provision of the service by one of the trainers cannot be kept due to force majeure, illness, accident or other circumstances for which the organiser is not responsible, or if the lessor of the booked premises cannot provide the venue, the organizer is at Exclusion of any obligation to pay compensation is entitled to name a replacement date and / or location. In the event of short-term failures, the organizer has no obligation to pay compensation.

2.2. The client is aware of the scope, form, subject matter and aim of the services.

2.3. The workshop participant recognizes the copyright of the organiser/ trainer in the works created by them (training documents, etc.). Reproduction and / or distribution of the aforementioned works is expressly prohibited. Any reproduction/ copying/ distribution of the organiser/trainer’s material requires the prior and express written consent of the organiser/ trainer.

2.4. By booking a seminar, the participant agrees, that photo, sound and film recordings can be recorded during the event, that these can be used for the media and for the organizer's advertising/marketing measures.

 

3. Ensuring performance – The German Careers Program

3.1. When booking workshop organized by the organizer, a full down payment is due immediately to book a confirm enrollment for the workshop.

3.2. Deduction of discounts, discounts, etc. from the invoice amount is not permitted.

3.3. If a part of the invoice amount or the workshop fee is still open on the workshop date, the participant is not entitled to participate in the workshop / consulting service. Registration is binding for the workshop participants.

3.4 In the event of cancellation up to 2 weeks before the start of the seminar / congress, 50% of the seminar fee is due in full as a processing fee. The full seminar fee is also payable in full if a rebooking has been made and the cancellation is not made up to 2 weeks before the date of the original workshop / consulting appointment start. The participant can provide the flat rate with proof that the damage did not occur at all or was significantly less than the flat rate. Cancellation costs also do not apply if a replacement participant is provided. The written appointment of a replacement person is possible up to 5 days before the start of the workshop with a processing fee of €50. Cancellation of the workshop at or after the start of the seminar is not possible.

3.5. If a participant cannot attend the booked workshop/ consulting appointment due to illness, death, accident or other circumstances, he is not entitled to reimbursement of the paid workshop/consulting appointment price. The organizer is free to rebook the participant to another workshop out of goodwill and upon presentation of appropriate proof (see point 3.6.). The declaration must be in writing.

3.6. Re-bookings are only possible with the consent of the organizer up to 7 days before the start of the workshop. There is no entitlement to this. The rebooking to another date is possible as soon as the full payment has been made. If the client/participant changes the booking to another date or workshop, a fee of 25% of the workshop fee will be charged. If the workshop is paid in full, you can change your booking once free of charge. Another rebooking is possible for the fee mentioned. If the seminar has not been attended within 6 months after payment, the right to participate will lapse.

3.7. Free additional places are excluded from the possibility of rebooking and expire if they are not used.

3.8. The customer agrees that the invoice will be sent to him at his email address.

3.9. The client is responsible for hotel reservations and the hotel bill (and for any cancellations), travel expenses (including cancellations, if any) and personal expenses for the duration of the workshop.

3.10. The workshop participant is obliged to pay the full invoice amount to the organizer's account, so any bank charges must be borne by the participant.

3.11 The workshop fee can not be paid in installments as an alternative to the payment method mentioned.

3.12 There is no assurance, guarantee or promise of a job or German visa, of any kind, to the participants in the program. Attending the program does not entitles any participant nor is the responsibility of CDG to arrange a gainful employment or job or similar in any way. CDG is absolved of any such future responsibility.

3.13 The weekly zoom sessions for the participants will be for a 4 week duration, not exceeding 4 sessions of 1 hour each. At the discretion of the organiser, CDG, more sessions can be scheduled. There is no obligation or undertaking from CDG to offer more than 4 session of 1 hour each to the participants of this program.

3.14 The availability of special guest speakers and other professionals is based on scheduling and other factors. While CDG makes all possible efforts, there is no guarantee of such speaker or guest if the scheduling or other factors can not be worked out. 

 

4. CDG – Personal consulting appointments

For these events, instead of points 3.1. until 3.7. The following regulations apply: When booking one of these appointments, the full admission price is due for payment immediately. Cancellation of appointment is not possible. If, for whatever reason, the consulting appointment client cannot attend the appointment, the consulting costs cannot be refunded. However, the possibility of naming a substitute remains.

 

5. Special agreements for subscriptions (e.g. CDG e-books, weekly webinars, monthly events)

5.1. The service begins with the first payment.

5.2. When paying by direct debit, the specified account must be adequately covered. If a payment transaction is booked back due to insufficient cover, due to incorrectly transmitted data by the customer or due to an objection, the customer will be charged a reminder fee of €10,00 plus the return debit fees. The subscriber can provide the flat rate with evidence that the damage did not occur at all or was significantly less than the flat rate. The organizer expressly reserves the right to prove further damage.

5.3. If the subscriber is in default of payment (there is a delay as soon as a weekly fee cannot be debited), the organizer is entitled to charge interest on arrears of up to 5% above the base rate p. announced by the European Central Bank. a. to promote. The subscriber can provide the flat rate with evidence that the damage did not occur at all or was significantly less than the flat rate. The organizer expressly reserves the right to prove further damage.

5.4. If a weekly contribution is in arrears, further delivery will be stopped immediately.

5.5. If the subscriber is in arrears with more than 3 debits, the contributions are due immediately for the entire term until the end of the contract. The subscriber can provide evidence that the damage did not occur at all or was significantly less. The organizer expressly reserves the right to prove further damage.

5.6. If the bank details of the participant change after registration, the participant is obliged to notify the organizer of the changed data.

5.7. Cancellation is not possible during the current subscription period. The term ends automatically.

5.8. The organizer can prematurely release the subscriber if the customer pays the contract acceptance fee (amounting to € 25) and provides a suitable successor who takes over the contract and there are no doubts as to its creditworthiness when it is checked. In this case, all payment obligations and all services are transferred to the successor without exception. The original subscriber cannot use any services after the takeover.

5.9. Digital content is usually provided by means of a password-protected online access. The provision of digital content at the specified time cannot be guaranteed. The organizer will immediately eliminate any malfunctions for which the organizer is responsible, within the scope of what is technically and operationally reasonable.

5.10. If workshop visits are included in the booked subscription, these can be used as soon as the workshop price has been paid. The workshop visits included can be used within 12 months of booking. If the workshop visits are not used during this period, the right to participate will lapse.

5.11. The content CAN NOT be reproduced/ copied/ distributed or made publicly available. The data provided to the subscriber may only be used by the subscriber himself to achieve his learning goals. The content is for subscriber’s PERSONAL USE only. The commercial use of application of the content by the subscriber is expressly prohibited under all circumstances. In the event of misuse, financial compensation will be claimed by CDG (represented by AMS Consulting UG). The organizer is entitled to sign digital content with invisible watermarks.

 

6. Revocation

 

There is no right of withdrawal for contracts with entrepreneurs, that is, according to § 14 BGB, natural or legal persons or partnerships with legal capacity, who act in the exercise of their commercial or independent professional activity when concluding the contract. However, if you are a consumer within the meaning of § 13 BGB, you have the right of cancellation described below.

 

Right of withdrawal

 

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must contact us (AMS Consulting UG c/o Mahajan, Loschmidtstr 13, 10587 Berlin, Tel .: 0049 (0) 176 75019653, info@careersdevelopmentgroup.com) inform you of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post or email). You can use the legal model withdrawal form to be obtained from us, but this is not mandatory (www.careersdevelopmentgroup.com). To meet the cancellation deadline, it is sufficient for you to send your communication regarding your exercise of the right of cancellation before the cancellation period expires.

Consequences of cancellation

 

If you cancel this contract, we have made all payments we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you chose a different type of delivery than the cheapest standard delivery we offer have) to repay immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. If you have requested that the service should start during the cancellation period, you have to pay us an appropriate amount, which is the proportion of the services already rendered in the service up to the point in time when you inform us of the exercise of the right of cancellation with regard to this contract Compares to the total scope of the services provided in the contract. 7. Data storage / data protection

7.1. The CDG (represented by AMS Consulting UG) informs that it processes personal data in order to fulfill contractual obligations, taking into account the data protection requirements. 7.2. The organizer is entitled to transfer the customer's inventory data to third parties insofar as this is necessary for the purpose of assignment or collection of the claims. The legally permissible transmission of further customer data for the purpose of collecting claims remains unaffected. The customer will be notified of the commissioning of a debt collection agency in writing.

 

8. Delivery of goods by the CDG (represented by AMS Consulting UG) online shop

8.1. Conclusion of contract: Your order (homepage, telephone, e-mail, fax, letter, personally) represents an offer to us to conclude a purchase contract. We accept this offer when the goods are dispatched.

8.2. Warranty / liability: The liability for the delivered goods is limited to a replacement delivery. Claims for a reduction in remuneration are excluded. If the inspection of the defective goods reveals that the defects are due to the fault of the buyer (e.g. damage due to improper handling), the buyer bears the costs of the replacement delivery; We reject any liability for any hardware damage caused by the copy protection. This does not apply to the violation of essential contractual obligations and the lack of guaranteed properties.

8.3. Delivery conditions: Unless otherwise agreed, delivery is made by the agency commissioned by us to the delivery address specified by the customer. A delay in delivery never leads to a reduction in the sales price. This means there are no additional costs. The delivery is for physical products with Hermes shipping. For deliveries to other countries, the appropriate shipping route is selected and the shipping costs are billed at cost.

8.4. Prices: Discounts and discounts not shown on the invoice cannot be granted. Price changes and errors are reserved. For physical shipments to invoice recipients within the EU, a VAT number (UIN, ATU, VAT, etc.) can be delivered without calculating German VAT. Deliveries to invoice recipients outside the EU are delivered without German VAT (only applies to goods orders).

8.5. Retention of title: The delivered goods remain the property of CDG (represented by AMS Consulting UG) (owner: Arun Mahajan) until full payment has been made.

 

9. General conditions

9.1. Should individual provisions of these general terms and conditions be or become ineffective, the effectiveness of the conditions will not be affected. The parties will then implement the terms as effective replacement regulations that come as close as possible to the purpose of the omitted provision.

9.2. German law applies exclusively to the conditions and their implementation.

9.3. Exclusive place of jurisdiction for all claims from the contract connected with these terms and conditions and these conditions is the seat of the organizer.

9.4. The participant agrees to be informed about news and events by the organizer via email and mobile phone.
